Important changes to lien claim laws become effective July 1, 2012

Senate Bill 189, passed in 2009 by California legislatures, institutes a significant overhaul of lien claim laws. Lien claims include mechanic’s liens, stop notice claims, and claims on public works payment bonds.

The bill provided that most of the changes become effective July 1, 2012.

The bill recodifies the entire lien law section of the Civil Code, and moves it from Section 3082 et sec. (which will be repealed) to Section 8000 et seq.

Among the changes are modifications to pre-lien forms and lien release forms. Last & Faoro has put together forms which conform to the new laws, which can be found here: pre-lien forms for public and private works and lien release forms. Starting July 1, 2012 these forms are mandatory and old forms may not be effective.

Also we had put together a new mechanic’s lien form, which has been required since January 1, 2012.
